{"id":5208,"date":"2011-08-08T06:07:54","date_gmt":"2011-08-08T04:07:54","guid":{"rendered":"http:\/\/blog.ultimatefatburner.com\/?p=5208"},"modified":"2011-08-08T06:07:54","modified_gmt":"2011-08-08T04:07:54","slug":"homeopathy-on-trial","status":"publish","type":"post","link":"https:\/\/www.ultimatefatburner.com\/ufb-blog\/homeopathy-on-trial\/","title":{"rendered":"Homeopathy on Trial?"},"content":{"rendered":"<p>Not yet, but it could happen.\u00a0Via the\u00a0&#8220;<a href=\"http:\/\/www.thejayfk.com\/?p=960\" target=\"_blank\" rel=\"noopener\">Journal of Are You Fucking Kidding&#8221; (JAYFK)<\/a>, comes\u00a0an update\u00a0on a class-action lawsuit in California against Boiron, one of the largest manufacturers of homeopathic products in the world.<\/p>\n<p>Why? <a href=\"http:\/\/www.courthousenews.com\/2010\/09\/02\/SnakeOil.pdf\" target=\"_blank\" rel=\"noopener\">Because\u00a0one of its products, &#8220;Children&#8217;s Coldcalm,&#8221;\u00a0is &#8220;&#8230; nothing more than a sugar tablet.&#8221;<\/a><\/p>\n<blockquote><p>Defendants are defrauding Californians by claiming that a tablet called &#8220;Children&#8217;s Coldcalm&#8221; pellets, will provide relief from&#8221; sneezing, runny nose, nasal congestion, sinus pain, headaches, and sore throat.<\/p>\n<p>These assertions would be welcomed if they were accurate, but the claims are absolutely false. The product is nothing more than a sugar tablet. Plaintiff brings this lawsuit to enjoin ongoing deceptions and to recover the profits generated by these false and misleading claims.<\/p>\n<p>&#8230;Earlier this year, Plaintiff purchased Children&#8217;s Coldcalm. She did so after reading, believing and relying upon the advertising claims attached as Exhibits 1 and 2. Plaintiff&#8217;s family used Children&#8217;s Coldcalm as directed, but did not obtain the results promised by Defendant&#8217;s advertising. It was worthless to them and provided no benefits. In reality, Children&#8217;s Coldcalm has no impact on the common cold.<\/p><\/blockquote>\n<p>The suit was originally filed last year, but the lead plaintiff, Gina Delarosa, just beat back a motion by Boiron to\u00a0dismiss the case.<\/p>\n<p><!--more--><br \/>\n<a href=\"http:\/\/www.courthousenews.com\/2011\/08\/01\/38625.htm\" target=\"_blank\" rel=\"noopener\">I love how the Courthouse News Service\u00a0reported it&#8230;<\/a><\/p>\n<blockquote><p>(CN) &#8211; A federal judge refused to toss a class action against the makers of allegedly useless homeopathic cold medicine made from plants, insects, metals and poison.<\/p>\n<p>Boiron moved for a judgment on the pleadings, saying federal law pre-empted Delarosa&#8217;s claims.<br \/>\n\u00a0\u00a0\u00a0\u00a0<br \/>\nU.S. District Judge Josephine Staton Tucker disagreed.<br \/>\n\u00a0\u00a0\u00a0\u00a0<br \/>\nThe Federal Food, Drug, and Cosmetic Act&#8217;s (FDCA) definition of &#8220;drug&#8221; includes homeopathic remedies like Coldcalm, but the Food and Drug Administration does not &#8220;vouch for, or even investigate, homeopathic drugs&#8217; safety and efficacy,&#8221; Tucker wrote.<\/p>\n<p>&#8230;&#8221;Indeed, under defendant&#8217;s arguments, defendant could state that Coldcalm would relieve symptoms of allergies, lessen headaches and back pain, improve a person&#8217;s visage, and eliminate the occurrence of body odor, regardless of whether the drug did any of these things, without violating the FDCA,&#8221; Tucker wrote.<\/p><\/blockquote>\n<p>I love it: &#8220;&#8230;allegedly useless homeopathic cold medicine made from plants, insects, metals and poison.&#8221; But if you read <a href=\"http:\/\/www.thejayfk.com\/?p=960\" target=\"_blank\" rel=\"noopener\">the JAYFK post<\/a>, you&#8217;ll see that this is\u00a0precisely the case.\u00a0The list of ingredients is just a highly diluted hodgepodge of irrelevant and\/or nasty junk, including\u00a0onion, honeybees (yes, you read that right&#8230;), potassium dichromate, belladonna, and other toxic plants.\u00a0<\/p>\n<p>If\u00a0the case ever goes to trial, Boiron will be forced to &#8220;prove&#8221; that\u00a0this garbage pail of a\u00a0product actually works.
