{"id":2996,"date":"2009-12-03T07:16:45","date_gmt":"2009-12-03T05:16:45","guid":{"rendered":"http:\/\/blog.ultimatefatburner.com\/?p=2996"},"modified":"2015-03-09T11:12:48","modified_gmt":"2015-03-09T15:12:48","slug":"bsn-1-muscletech-0","status":"publish","type":"post","link":"https:\/\/www.ultimatefatburner.com\/ufb-blog\/bsn-1-muscletech-0\/","title":{"rendered":"BSN 1, Muscletech 0"},"content":{"rendered":"<p>LOL &#8211; Muscletech just bit the dust in a patent-infringement case against BSN &#8211; thanks to a supplement ad in Flex Magazine &#8211; from June, 1996.\u00a0 <a href=\"http:\/\/www.sriplaw.com\/magazine-ad-for-nutritional-supplement-invalidates-patent-claims\/\" target=\"_blank\" rel=\"noopener\">According to Judith Grubner of Nutrisuplaw.com<\/a>:<\/p>\n<blockquote><p>The U.S. Court of Appeals for the Federal Circuit just applied this provision to invalidate patent claims for a nutritional supplement method to enhance muscle performance or recovery from muscle fatigue, based on an advertisement for Weider\u2019s VICTORY\u2122 Professional Protein published in the June 1996 issue Flex Magazine.<\/p>\n<p>Iovate Health Sciences, Inc. [the parent company of Muscletech] is the exclusive license holder of U.S. Patent No. 6,100,287 (the \u201c\u2019287 Patent\u201d), owned by the University of Florida Research Foundation, Inc. The patent claimed a method for enhancing muscle performance or recovery from fatigue involving certain kinds of ketoacids and amino acids.\u00a0 Iovate and the Foundation sued Bio-Engineered Supplements &amp; Nutrition, Inc. (\u201cBSN\u201d) for infringing certain claims of the \u2018287 patent.\u00a0 BSN countered that the patent claims were invalid because the Flex ad was published before the critical date and was detailed enough to teach a \u201cperson skilled in the art\u201d how to practice the method claimed in the patent.\u00a0 The judge agreed, invalidating those patent claims.<\/p><\/blockquote>\n<p><!--more-->Apparently, you can&#8217;t get a patent for an invention described in a printed publication more than 1 year before the application.<\/p>\n<p>For the record, <a href=\"http:\/\/patft.uspto.gov\/netacgi\/nph-Parser?Sect1=PTO1&amp;Sect2=HITOFF&amp;d=PALL&amp;p=1&amp;u=%2Fnetahtml%2FPTO%2Fsrchnum.htm&amp;r=1&amp;f=G&amp;l=50&amp;s1=6100287.PN.&amp;OS=PN\/6100287&amp;RS=PN\/6100287\" target=\"_blank\" rel=\"noopener\">patent 6,100,287<\/a> is the one cited for Muscletech&#8217;s GAKIC supp\u00a0(glycine-l-arginine-alpha-ketoisocaproic acid calcium). While it&#8217;s clear from the description in the Apellate court&#8217;s decision that the Weider\u00a0\u00a0product is\u00a0quite different from Muscletech&#8217;s, the patent description is\u00a0vague enough to cover both supps. As the court held:<\/p>\n<blockquote><p>We agree with BSN that the Professional Protein ad discloses each and every limitation of the claims asserted by Iovate. There is no dispute that the Professional Protein ad discloses a composition comprising a cationic or dibasic amino acid (ornithine) and a ketoacid (alpha-ketoglutarate) as well as the additional limitations found in claims 2 (glutamine), 5 (alpha-ketoisocaproic acid), 7 (arginine), 8 (conjugated amino acid and ketoacid, here ornithine-alpha-ketoglutarate), 9 (administered orally), and 18 (used on a human).
